01Acceptance of These Terms

Welcome to OK Petroleum. These Terms of Use ("Terms") govern your access to and use of our website, online store, mobile app, and services (together, the "Services"). By accessing our website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, please do not use our Services.

02Eligibility & Accounts

You must be at least 18 years old and able to enter into a binding contract to place an order or use an account. When you create an account, you agree to provide accurate, current information and to keep your login credentials secure. You are responsible for all activity that occurs under your account, and you agree to notify us promptly of any unauthorized use.

03Orders, Pricing & Payment

All orders are offers to purchase and are subject to our acceptance and to product and fuel availability. Heating oil and fuel prices move with the market and are confirmed at the time your order is placed or, for scheduled deliveries, at the time the order is processed.

• Per-gallon pricing. Heating oil is priced per gallon. The package price shown on our website is the per-gallon rate multiplied by the gallons in that package, with the applicable county fuel tax included where shown.
• Scheduled deliveries are priced when the order is processed, not when you set up the schedule. The prices shown when you create or edit a delivery schedule are that day's rates only. Each scheduled delivery is charged approximately 24 hours before delivery at the per-gallon price in effect at that time, which may be higher or lower than the price shown when you scheduled it. See Automatic & Scheduled Delivery.
• We work hard to keep pricing and product information accurate, but errors can occur. We reserve the right to correct errors and to refuse, limit, or cancel any order — including after it has been submitted.
• Payment is due as specified at checkout. By providing a payment method you represent that you are authorized to use it.
• Applicable taxes, fees, and delivery minimums may apply and will be shown before you complete your order where required.

04Delivery & Service

We deliver to serviceable addresses across Nassau and Suffolk Counties. To receive a safe, complete delivery, you agree to:

• Provide clear, unobstructed access to your fill pipe and tank;
• Ensure your tank, fill pipe, vent, and heating equipment are in safe, working condition; and
• Give accurate delivery information and instructions.

Delivery timing is not guaranteed. Deliveries usually arrive within 24 hours of the order being processed, but delivery windows are estimates and may be affected by weather, high demand, road conditions, or other circumstances beyond our control. If your delivery will be delayed we will contact you using the phone number or email on your order, and you can reach us at any time at 631-994-1277. We are not responsible for conditions caused by pre-existing equipment problems or unsafe tanks.

05Automatic & Scheduled Delivery

If you enroll in automatic or scheduled delivery, you authorize us to deliver fuel and to charge your saved payment method on a recurring basis according to the plan you select. Enrolling in automatic delivery does not remove your responsibility to monitor your tank level.

• You are not charged when you set up a schedule. For each scheduled delivery we create the order and charge your saved payment method approximately 24 hours before the delivery date.
• The price is set when the order is processed. Because heating-oil prices change daily, each delivery is billed at the per-gallon price in effect at the time the order is processed (about 24 hours before delivery), plus any applicable taxes. That price may be higher or lower than the price displayed when you created the schedule, and we do not guarantee any price shown in advance.
• Delivery timing may vary. Deliveries usually arrive within 24 hours of the order being processed. High volume, inclement weather, or other circumstances beyond our control can delay a delivery. If that happens we will contact you, or you can call us at 631-994-1277.
• Your acknowledgement is required and kept on record. When you create or edit a delivery schedule you must confirm that you understand the pricing and delivery-timing terms above. We keep a record of that acknowledgement (what you accepted, the date and time, and the price displayed to you) with your schedule and each order it generates. See our Privacy Policy.
• Changes and cancellations. You may pause, edit, or cancel a schedule in your account at any time. Changes made before an order is processed apply to that delivery; once an order has been processed and charged, it is a placed order and the Cancellations, Returns & Refunds section applies. New schedules require the minimum notice shown in your account before the first delivery.
• Payment problems. If we cannot charge your saved payment method, the delivery is placed on hold and we will notify you. Repeated failures pause the schedule until a working payment method is added.

06Cancellations, Returns & Refunds

Because heating oil and fuel are delivered and consumed, they cannot be returned once delivered. You may cancel an order before it is dispatched by contacting us as soon as possible. Marketplace and product orders may be eligible for return or refund in accordance with the return policy shown at the time of purchase. Approved refunds are issued to the original payment method.

07Acceptable Use

You agree not to misuse the Services. In particular, you will not:

• Attempt to gain unauthorized access to our systems, accounts, or networks;
• Interfere with or disrupt the Services, or introduce malware or harmful code;
• Scrape, harvest, or collect data from the site except as permitted; or
• Use the Services for any unlawful, fraudulent, or abusive purpose.

We may suspend or terminate access for any conduct that violates these Terms or that we reasonably believe is harmful.

08Intellectual Property

All content on our website — including text, graphics, logos, images, and software — is owned by or licensed to OK Petroleum and is protected by intellectual-property laws. You may use the site for your personal, non-commercial purposes only. You may not copy, reproduce, republish, or distribute our content without our prior written permission.

09Third-Party Links & Services

Our Services may link to or rely on third-party sites and services — such as payment processors, mapping providers, app stores, and product manufacturers. We do not control and are not responsible for their content, products, or practices. Your use of those services is governed by their own terms and policies.

10Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, secure, or error-free.

11Limitation of Liability

To the fullest extent permitted by law, OK Petroleum and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the Services. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12Indemnification

You agree to indemnify and hold harmless OK Petroleum and its team from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or your violation of these Terms.

13Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. You agree that any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Suffolk County, New York, and you consent to their personal jurisdiction and venue.

14Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Your continued use of the Services after changes are posted means you accept the revised Terms.
